Effective August 1, 2026
New Jersey’s new “Skip the Stuff” law officially takes effect on August 1, 2026, bringing significant changes to how restaurants, food trucks, convenience stores, and third-party delivery platforms provide disposable utensils and condiment packets.
Under the new law, businesses may no longer automatically include single-use plastic forks, knives, spoons, straws, napkins, or condiment packets with takeout or delivery orders. Instead, these items may only be provided when specifically requested by the customer.
For full-service dine-in restaurants, reusable utensils are expected to become the standard whenever practical.
The legislation is designed to reduce plastic waste across New Jersey while encouraging consumers to request disposable items only when they are actually needed.
