New Jersey Bans Automatic Plastic Cutlery

Effective August 1, 2026

New Jersey’s new “Skip the Stuff” law officially takes effect on August 1, 2026, bringing significant changes to how restaurants, food trucks, convenience stores, and third-party delivery platforms provide disposable utensils and condiment packets.

Under the new law, businesses may no longer automatically include single-use plastic forks, knives, spoons, straws, napkins, or condiment packets with takeout or delivery orders. Instead, these items may only be provided when specifically requested by the customer.

For full-service dine-in restaurants, reusable utensils are expected to become the standard whenever practical.

The legislation is designed to reduce plastic waste across New Jersey while encouraging consumers to request disposable items only when they are actually needed.

What This Means for the Foodservice Industry

The regulation is expected to change purchasing patterns throughout the disposable packaging market.

While demand for traditional plastic cutlery is likely to decline, distributors should expect increased interest in environmentally friendly alternatives such as:

  • Wooden cutlery
  • Bamboo utensils
  • Compostable products
  • Paper-wrapped cutlery kits
  • Sustainable foodservice packaging solutions

Restaurants and distributors that prepare early will be better positioned to comply with the law while meeting changing customer expectations.
